John heads the Medicare Secondary Payer (MSP) Compliance group for Garretson Resolution Group. In his role, John counsels attorneys, risk managers and insurance carriers nationwide with respect to MSP compliance under the Medicare Secondary Payer Act. Specifically, he works with clients to develop and execute comprehensive MSP reimbursement protocols which properly consider and protect Medicare’s past and future interests. His work allows clients to verify and resolve in full any conditional payments made by Medicare on behalf of a beneficiary as well as determining when/how to address Medicare’s future interest by identifying fact patterns where Medicare Set-Aside Arrangements (MSAs) should be considered as a part of workers’ compensation, liability and no-fault settlements. In so doing, John achieves his goal of transforming clients into more efficient and profitable law firms and business units.
John is a frequent speaker at continuing education events nationwide on the subject of MSP compliance. He has authored or co-authored several articles which have been published, including “Modernizing MSP Cost Containment Protocols” and “Medicare Set-Aside Arrangements Under the Medicare Secondary Payer Act.” For years, John has been updating GRG’s MSA White Paper, the leading academic analysis of MSA obligations under the MSP Act, to take into account the most recent statutory, regulatory and administrative guidance from the federal government, as well as relevant case law, annually so that the settlement community understands its obligations with respect to future medicals more clearly. His work has been cited by multiple federal court opinions as “comprehensive and detailed”, “reasonable and reliable”, and “…more credible [than others] in the liability context.”
John received his B.A. in International Studies from the University of North Carolina at Chapel Hill in 1997, and his J.D./M.B.A. from Villanova University in 2003. Licensed to practice law in North Carolina and South Carolina, John is a member of the Mecklenburg County Bar, the North Carolina Bar Association, the South Carolina Bar Association and the American Bar Association. Serving as a neutral third party with respect to Medicare compliance, John is a member of AAJ, WILG, NAMSAP, CLM and DRI. Within DRI, John serves as the Chair of the DRI Medicare Secondary Payer Task Force, on the Workers’ Compensation Committee as the Chair of its Medicare Compliance Subcommittee & Legislative/Rulemaking Liaison and on the Young Lawyers Steering Committee as Sponsorship Chair.
